Bicy Data Protection

We are fully aware of the trust you place in us, as well as our responsibility regarding the protection of personal data you transmit to us. That is why we have written this article. It aims to inform you about the types of information we collect when you use our Site, for what purposes, and how we have decided to use this data to better meet your expectations. This Policy is an integral part of the Bicy terms and conditions that apply otherwise. By providing us with personal data, you consent to us collecting, storing, and using it according to the applicable legislation and the terms and conditions of this Policy. If you disagree with these, we invite you not to provide us with any personal data. If you refuse or withdraw your consent or choose not to provide us with the required personal data, we may be unable to provide you with all or part of our services. If you have questions or comments regarding this Policy or comments aimed at improving its quality, please write to us at info@bicy.ch.

1. What data do we collect?

We collect personal data in two ways: - Information you freely choose to provide us: To access our services, especially to place an order via our Site, you must provide us with a certain amount of personal information, such as your first name, last name, email address, postal address, phone number, ID card, copy of utility bill (water, electricity, gas, internet, phone, etc.) etc. - Information we automatically collect when you use our Site: Beyond the data you freely choose to provide us to access our services, we collect and use various information regarding your behavior on our Site (your browsing preferences, the pages of our Site you have viewed, your order history, etc.). Furthermore, when you use services offered by third-party companies (Google Maps™, YouTube™, etc.) from our Site, we draw your attention to the fact that these companies may also collect personal data about you (your location, usage preferences, etc.) through these services. Therefore, before using these services, we recommend that you carefully read the privacy policies of these third-party companies.

2. How do we use the data collected?

We use the information you freely choose to provide us specifically to achieve the purposes for which you transmitted it to us, such as placing an order via our Site, participating in a Contest, or interacting with our Customer Service. We also reserve the right to use all or part of this information for other purposes, such as communicating with you, conducting surveys, or recommending our services (or our partners' services) that may interest you. Regarding the information about your behavior on the Site that we automatically collect, we use it to improve and personalize our services to better meet your expectations.

3. To whom is the data communicated?

Certain data concerning your credit cards is transmitted to our partners Datatrans SA and Nexi Schweiz AG.

Your first name, last name, gender, date of birth, address, phone number, and email are automatically transmitted with each order to our partner CRIF AG to check your creditworthiness.

On your side, you can share certain information on social networks, notably by using the Facebook™ or Instagram™ buttons available on our Site. Remember that when you publicly share information, it can be indexed by search engines.

4. Our use of cookies

For the optimization of our Site, we use cookies. These are small files that are saved on your data storage device and that store, through your Internet browser, certain configurations and certain data to exchange with our system. You can refuse the installation of cookies by making the corresponding settings on your browser software; however, we draw your attention to the fact that you may then no longer have access to all our services. The cookies we use cannot be linked to a particular person. When a cookie is activated, an identification number is assigned to the respective cookie. Linking your personal data with this identification number is not possible. At no time is there any recording of your name or other similar data that would allow linking the cookies to you. Thanks to cookie technology, we only obtain anonymous information indicating, for example, which pages of our Site have been viewed.

5. Our use of IP addresses

Any computer or device connected to the Internet is assigned an IP (Internet Protocol) address. IP addresses are generally assigned by blocks for each country. They can thus be used to identify the country, region, and city where the computer connects to the Internet. As websites must necessarily use IP addresses for the Internet to work, Bicy may have access to - and keep a history of - your IP address(es).

6. The tracking methods we use

To improve our services, we use the Google Analytics™ technology provided by Google Inc., based in the United States (Google). Google Analytics™ is an Internet audience analysis tool that allows us to better understand your behavior on our Site. This tool may use cookies to collect anonymous information and generate reports on our Site's usage statistics without you being personally identified by Google. The information produced by these cookies (including your IP address) may be sent to - and stored on - Google's servers in the United States. Bicy also uses the advertising features of Google Analytics™ or Facebook™, so advertising cookies may be used to enable certain features such as remarketing (e.g., for products like AdWords™ on Google's Display Network). By using our Site, you consent to the processing of the data collected about you in accordance with the explanations above and Google's™ and Facebook's™ privacy policies.

7. Right of access and rectification

In accordance with data protection legislation, you have the right to be informed free of charge about the data recorded about you and, when these appear inaccurate or incomplete, the right to rectify or delete them. To rectify your data, simply log in to your account, go to your account, and make the necessary changes. To delete them, please contact the address mentioned below. Unless we need to retain all or part of it for business or legal purposes (e.g., to provide after-sales service on the products you ordered or if the law requires us to keep a copy of certain accounting documents), we will delete your personal data. However, we may retain certain connection data, demographic information, and statistics about you or keep an anonymized archival copy of your information. We also reserve the right to reject requests that are unreasonably repetitive, require disproportionate technical effort (e.g., developing a new system or fundamentally changing existing practices), or are simply impractical. If applicable, please send any request by postal mail or email ensuring that your identification is possible and unequivocal to: Bicy SA, Chemin des Ceps 1, 1217 Meyrin, info@Bicy.

8. Security of personal data

Your personal data is protected from unauthorized processing through appropriate technical and organizational measures.

Your documents (driver's license, identity card, residence permit) are stored with our partner Cloudinary with servers in the US. The rest of your information is stored via our partner MongoDB Inc with Amazon Web Service servers in Germany.

9. Abuse of service offerings

In case of misuse of our Site, especially in case of suspected punishable acts, personal data may be analyzed to clarify the situation and, upon duly justified request, may be transmitted to the competent official authorities or the third party concerned by the abuse.
